These Terms of Use are a binding agreement between you and Kibira Ventures LLC, an Indiana limited liability company d/b/a Get Indy Striping (“Get Indy Striping,” “we,” “us,” or “our”), regarding your use of getindystriping.com and related services.
By accessing the website, submitting a request, or checking a box indicating acceptance, you agree to these Terms.
1. The Services
Get Indy Striping is a lead-generation and referral platform. It may allow users to submit information about parking lot striping, pavement marking, asphalt maintenance, or related projects and to be connected with independent businesses or individuals that may offer those services (“Service Providers”).
Get Indy Striping may receive compensation from Service Providers for leads, calls, introductions, listings, advertising, or related opportunities.
2. Eligibility
You must be at least 18 years old and legally capable of entering a binding contract.
If you submit a request for a business, property owner, property manager, association, government entity, or other organization, you represent that you are authorized to act for that party.
3. Marketplace Role and Independent Service Providers
Get Indy Striping does not itself perform, supervise, direct, control, warrant, or guarantee parking lot striping, pavement marking, asphalt maintenance, or other contractor services.
Service Providers are independent third parties and are not employees, agents, representatives, partners, joint venturers, franchisees, or subcontractors of Get Indy Striping.
Submitting a request does not create a service contract between you and Get Indy Striping.
Any estimate, proposal, contract, deposit, payment, scheduling commitment, change order, warranty, or other agreement for contractor services is solely between you and the applicable Service Provider.
4. Project Requests
You agree that information submitted through the website will be accurate, current, and complete to the best of your knowledge.
You authorize Get Indy Striping to review and process your request, contact you about the request, share the information you provide with one or more independent Service Providers, and permit those providers to contact you about the requested project.
Submission does not guarantee that a Service Provider will respond, provide an estimate, accept the project, offer a particular price, or complete the work.
5. No Endorsement or Guarantee
Unless expressly stated otherwise, Get Indy Striping does not guarantee or make representations regarding a Service Provider’s:
- Licensing, registration, permits, certifications, bonding, or insurance;
- Qualifications, experience, reputation, or financial condition;
- Availability, pricing, workmanship, materials, safety, or completion dates;
- Employees, subcontractors, or suppliers;
- Warranties, refunds, or dispute handling; or
- Suitability for a particular project.
You are responsible for independently evaluating each Service Provider before hiring, including verifying credentials, insurance, references, pricing, warranties, and contract terms.
6. Customer and Service Provider Disputes
Any dispute concerning an estimate, contract, deposit, payment, scheduling issue, cancellation, property damage, personal injury, incomplete work, defective work, warranty, refund, mechanic’s lien, or other matter relating to contractor services must be resolved directly between the customer and the applicable Service Provider.
Get Indy Striping is not a party to agreements between customers and Service Providers and has no obligation to investigate, mediate, resolve, defend, or pay a claim arising from those agreements or services.
Get Indy Striping may, at its discretion, receive complaint information, request a response, assist with communication, suspend a provider, or refer a matter to appropriate authorities. Doing so does not make Get Indy Striping responsible for the dispute.
7. Release
To the fullest extent permitted by law, you release Get Indy Striping and its owners, officers, employees, representatives, affiliates, successors, and assigns from claims, losses, liabilities, damages, costs, and expenses arising from or relating to:
- Communications or dealings between you and a Service Provider;
- Services offered, performed, delayed, cancelled, or not performed by a Service Provider;
- Payments, deposits, refunds, estimates, contracts, warranties, liens, or representations made by a Service Provider; and
- The acts, omissions, negligence, misconduct, or legal violations of a Service Provider.
This release does not apply to liability that cannot lawfully be excluded or limited, or to claims arising directly from Get Indy Striping’s own fraud, intentional misconduct, or other conduct for which liability cannot be waived.
8. Payments to Providers
Unless expressly stated otherwise, Get Indy Striping does not collect, hold, process, direct, or guarantee customer payments to Service Providers.
Get Indy Striping is not responsible for deposits, financing, chargebacks, refunds, payment disputes, collection efforts, or liens arising between a customer and Service Provider.
9. Communication Consent
By submitting a request, you authorize Get Indy Striping and the independent Service Providers selected for your request to contact you by telephone, text message, and email about that request, subject to applicable law.
Message and data rates may apply. Reply STOP to opt out of text messages.
Separate prior express written consent must be obtained when legally required for prerecorded, artificial-voice, or automatically dialed marketing calls or texts.
10. Acceptable Use
You may not:
- Submit false, misleading, fraudulent, unlawful, or unauthorized requests;
- Impersonate another person;
- Submit another person’s information without permission;
- Harass, threaten, deceive, or unlawfully solicit anyone;
- Interfere with website operation or security;
- Introduce malware or harmful code;
- Scrape or extract data without written permission;
- Bypass access controls;
- Infringe intellectual property, privacy, or other rights; or
- Violate applicable law.
11. User Content
You retain ownership of information, photographs, files, text, and other materials you submit.
You grant Get Indy Striping a nonexclusive, worldwide, royalty-free license to host, store, reproduce, transmit, format, display, and disclose submitted materials as reasonably necessary to operate the website, process your request, connect you with providers, communicate with you, prevent fraud, enforce these Terms, and comply with law.
12. Intellectual Property
The website, including its design, text, graphics, logos, software, databases, and other content, is owned by or licensed to Get Indy Striping and protected by applicable law.
You may use the website only for lawful personal or internal business purposes.
13. Third-Party Content
The website may contain third-party content, links, reviews, advertisements, or integrations. Get Indy Striping does not control or endorse third-party content and is not responsible for its accuracy, security, availability, or practices.
14. Disclaimer of Warranties
To the fullest extent permitted by law, the website and related services are provided “as is” and “as available.”
Get Indy Striping disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and results.
Get Indy Striping does not warrant that the website will be uninterrupted, error-free, secure, or that any request will result in a response, estimate, contract, savings, or satisfactory project.
15. Limitation of Liability
To the fullest extent permitted by law, Get Indy Striping will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, data, business, or goodwill; or costs of substitute services arising from the website, a referral, communications with a Service Provider, or services provided by a Service Provider.
To the fullest extent permitted by law, Get Indy Striping’s total aggregate liability for all claims arising from the website or referral service will not exceed the greater of:
- The amount you paid directly to Get Indy Striping during the twelve months preceding the claim; or
- One hundred U.S. dollars ($100).
This limitation does not apply where prohibited by law.
16. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Get Indy Striping and its owners, officers, employees, representatives, affiliates, successors, and assigns from third-party claims arising from your unlawful use of the website, your submitted content, your violation of these Terms, or your fraud, willful misconduct, or material misrepresentation.

18. Termination
We may suspend or terminate access when we reasonably believe a user has violated these Terms, created legal or security risk, or misused the website.
19. Changes
We may modify the website or these Terms from time to time. Updated Terms will be posted with a revised Last Updated date.
20. Governing Law and Venue
These Terms are governed by Indiana law, without regard to conflict-of-law principles.
Before filing a lawsuit, the parties agree to make a good-faith effort to resolve the dispute by written notice. Unless applicable law requires otherwise, any judicial proceeding must be brought in the state or federal courts located in Marion County, Indiana.
Nothing prevents an eligible party from bringing a claim in small claims court.
21. Electronic Transactions
You consent to conduct transactions electronically and agree that electronic records, check-box acceptance, and electronic signatures may satisfy legal signature and writing requirements where permitted by law.
22. Miscellaneous
These Terms and incorporated policies are the entire agreement regarding the website unless another written agreement applies.
If a provision is unenforceable, the remaining provisions will remain effective.
Get Indy Striping’s failure to enforce a provision is not a waiver.
